Hmmm. While I appreciate your analysis of Mrs. O'Connor's consideration of the cases before her, I also find that, for many of us, what is and is not Constitutional is, in many cases, clear and easily decided.

To a strict constructionist (or "conservative"), the interstate commerce clause does not apply to a business simply because one of their suppliers uses a trucking firm that delivers to another customer who sells across state lines (hypothetical example in the absurd, but the recent eminent domain case is an actual example in the absurd).

I have to admit that at least the current crop of self-proclaimed borrow-and-spend, regulate-your-bedroom "conservatives" have corrupted the term beyond all recognition.

Alito on reliance on foreign law

"I don't think it's appropriate or useful to look to foreign law in interpreting the provisions of our Constitution," Judge Alito said in response to questions from Senator Tom Coburn, Republican of Oklahoma, in the third day of the judge's confirmation hearings before the Senate Judiciary Committee.

"I think the Framers would be stunned by the idea that the Bill of Rights is to be interpreted by taking a poll of the countries of the world," Judge Alito said. "The purpose of the Bill of Rights was to give Americans rights that were recognized practically nowhere else in the world at the time. The Framers did not want Americans to have the rights of people in France or the rights of people in Russia or any of the other countries on the continent of Europe at the time; they wanted them to have the rights of Americans."

Haggis,

John Kerry (remember him?) is apparently calling for a filibuster, but Biden is saying 'No'. Alito already has 59 votes lined up, and they can't get all the remaining Democrats to commit to the filibuster idea, so it looks the vote will proceed, favourably, and Justice Alito will be on the bench soon.

Let us hope that he lives up to all the Democrats worst fears. :D

None of the Dems have the stomach to call for a filibuster and as this poll indicates, most Americans would view a filibuster as a negative event.

Having said that, the Dems are now so beholden to the wacky, hate Bush Left that they might try to get one going.

That poll looks a bit wacky as well. Not all states are shown, and some of the polling was done over two months ago.

Having said that, if the Dems were going to filibuster(Kerry's a little late growing a pair, IMNSHO), they should have had their act together enough to present a united stance on it from the outset. This present farce is just wasting time, tax money, and media coverage.

Two questions and responses in the CBS poll intrigue me. The first asks if the respondent thinks Senate hearings should delve into an appointee's personal views on issues, and ~70% said "yes". The next question asks if an appointee's personal views on the issues should be a factor in his/her confirmation, and ~70% said "no".

Then why ask?

Just to be nosy, I suppose. It makes for good television. (As if 70% of the people are actually watching the Alito hearings.) :D

Actually, I have no idea. Nor, I suppose, did the respondents. They probably answer the one question with no thought as to its relevance to any others. that, I suppose, is why it's so easy for both sides to say the polls are in their favour.

I always thought it totally appropriate that Stop! In The Name Of Love was popular when my high school sweetheart rather ungraciously dumped me.

I also thought it was totally appropriate that Sheila was popular when I had a crush on a girl by that name.

I also thought it was totally appropriate that the TV show What Ever Happened To The Class Of '65? wasn't about the classes of '64 or '66.
